State med­ical mar­i­jua­na laws and fed­er­al sched­ul­ing

State Marijuana Laws

Today, forty-eight (48) states accept the med­ical use of mar­i­jua­na.  How­ev­er, marijuana’s clas­si­fi­ca­tion in the fed­er­al Con­trolled Sub­stance Act (CSA) has not changed as a result.  State laws are not sci­en­tif­ic evi­dence.  State laws are polit­i­cal acts.  The Drug Enforce­ment Admin­is­tra­tion (DEA) still uses the same analy­sis it used pri­or to 1996 when Cal­i­for­nia became State Mar­i­jua­na Laws

Olsen v. DEA Denies State Exemption

On Novem­ber 10, 2020, just a week after the elec­tions, the Drug Enforce­ment Admin­is­tra­tion (DEA) denied our peti­tion for a new fed­er­al reg­u­la­tion exempt­ing state med­ical cannabis pro­grams to be added as 21 C.F.R. §1307.32.  DEA explained that deny­ing the exemp­tion was nec­es­sary because it would cre­ate an exemp­tion: Your peti­tion is denied because the DEA Denies State Exemp­tion
