HF 978 should be amended to comply with federal drug law. 21 U.S.C. § 822(d)
At the subcommittee meeting on HF 978, Rep. Wills said he is not going to ask the federal government for permission. Respectfully, Rep. Wills has this backward. Don’t ask. Tell the federal government we are in full compliance with 21 U.S.C. § 822(d) and ask for an acknowledgement (a receipt retroactive to the date of enactment).
Asking military veterans with PTSD to swear an oath to violate federal drug laws and take hallucinogenic mushrooms is a recipe for additional trauma.
Military personnel swear an oath to defend the U.S. Constitution, not to violate federal drug laws. 10 U.S.C. §, 502.
Please do not require Iowans to violate federal drug law as a condition of medical treatment. House File 978, §§ 4, 11, 17, 26, and 27, require violation of federal drug laws as a condition of participation.
Legislators also swear an oath to defend the U.S. Constitution, not to authorize violation of the laws. Iowa Constitution, Article III, Section 32.
Use of schedule I controlled substances is not just a medical issue, it is a legal issue. The medical cannabidiol board has requested the legislature to authorize a legal task force for the past three years.
- In December 2022, the medical cannabis board requested legislation establishing a legal task force in its Annual Report to the legislature for the 2023 session.
- In December 2023, the medical cannabis board requested legislation establishing a legal task force in its Annual Report to the legislature for the 2024 session.

21 U.S.C. § 822(d) provides federal registration which would not require Iowans to swear an oath to violate federal drug laws to receive their medical treatment. Please amend HF 978 to include a legal task force to evaluate and prepare an application for registration under 21 U.S.C. § 822(d).
States can enact these types of law even if it is illegal to participate in them. Make the application retroactive back to the enactment of the program so if patients are forced to sign these invalid agreements they are forgiven.
