House File 978 is on the House Debate Cal­en­dar, on 4/21/2025.

HF 978 should be amend­ed to com­ply with fed­er­al drug law.  21 U.S.C. § 822(d)

At the sub­com­mit­tee meet­ing on HF 978, Rep. Wills said he is not going to ask the fed­er­al gov­ern­ment for per­mis­sion.  Respect­ful­ly, Rep. Wills has this back­ward.  Don’t ask.  Tell the fed­er­al gov­ern­ment we are in full com­pli­ance with 21 U.S.C. § 822(d) and ask for an acknowl­edge­ment (a receipt retroac­tive to the date of enact­ment).

Ask­ing mil­i­tary vet­er­ans with PTSD to swear an oath to vio­late fed­er­al drug laws and take hal­lu­cino­genic mush­rooms is a recipe for addi­tion­al trau­ma.

Mil­i­tary per­son­nel swear an oath to defend the U.S. Con­sti­tu­tion, not to vio­late fed­er­al drug laws.  10 U.S.C. §, 502.

Please do not require Iowans to vio­late fed­er­al drug law as a con­di­tion of med­ical treat­ment.  House File 978, §§ 4, 11, 17, 26, and 27, require vio­la­tion of fed­er­al drug laws as a con­di­tion of par­tic­i­pa­tion.

Leg­is­la­tors also swear an oath to defend the U.S. Con­sti­tu­tion, not to autho­rize vio­la­tion of the laws.  Iowa Con­sti­tu­tion, Arti­cle III, Sec­tion 32.

Use of sched­ule I con­trolled sub­stances is not just a med­ical issue, it is a legal issue.  The med­ical cannabid­i­ol board has request­ed the leg­is­la­ture to autho­rize a legal task force for the past three years.

  • In Decem­ber 2022, the med­ical cannabis board request­ed leg­is­la­tion estab­lish­ing a legal task force in its Annu­al Report to the leg­is­la­ture for the 2023 ses­sion.
  • In Decem­ber 2023, the med­ical cannabis board request­ed leg­is­la­tion estab­lish­ing a legal task force in its Annu­al Report to the leg­is­la­ture for the 2024 ses­sion.
  • In Decem­ber 2024, the med­ical cannabis board request­ed leg­is­la­tion estab­lish­ing a legal task force in its Annu­al Report to the leg­is­la­ture for the 2025 ses­sion.

HF 978 § 6(6) refers to the Med­ical Cannabis Act, Chap­ter 124E:

A psilo­cy­bin pro­duc­tion estab­lish­ment may be locat­ed at the same loca­tion as a med­ical cannabid­i­ol man­u­fac­tur­er licensed pur­suant to sec­tion 124E.6 if a sep­a­rate license is obtained for each.

HF 978 § 6(10) refers to the Med­ical Cannabis Act, Chap­ter 124E:

The licens­ing board may, at the dis­cre­tion of the licens­ing board,grant pref­er­ence to an appli­cant who cur­rent­ly holds a med­ical cannabid­i­ol man­u­fac­tur­er license issued pur­suant to sec­tion 124E.6.

21 U.S.C. § 822(d) pro­vides fed­er­al reg­is­tra­tion which would not require Iowans to swear an oath to vio­late fed­er­al drug laws to receive their med­ical treat­ment.  Please amend HF 978 to include a legal task force to eval­u­ate and pre­pare an appli­ca­tion for reg­is­tra­tion under 21 U.S.C. § 822(d).

States can enact these types of law even if it is ille­gal to par­tic­i­pate in them.  Make the appli­ca­tion retroac­tive back to the enact­ment of the pro­gram so if patients are forced to sign these invalid agree­ments they are for­giv­en.
