Federal Exemption for Medical Cannabis

SF 69 fed­er­al exemp­tion task force
1.  Jan­u­ary of 2020 the Iowa Med­ical Cannabid­i­ol Board rec­om­mend­ed the Iowa Depart­ment of Health and Human Ser­vices obtain a fed­er­al exemp­tion for Iowa’s med­ical cannabis pro­gram to pro­tect schools, and long-term and acute care facil­i­ties that receive fed­er­al fund­ing.
2.  Sep­tem­ber of 2020 the Iowa Depart­ment of Health and Human Ser­vices agreed to apply for a fed­er­al exemp­tion for Iowa’s med­ical cannabis pro­gram, but hasn’t made any progress since then.
3.  August of 2022 the depart­ment said, “ a lot of peo­ple need to be involved in mak­ing sure that’s han­dled in a way that’s fine with every­body.”
4.  Jan­u­ary of 2023 the Iowa Med­ical Cannabid­i­ol Board rec­om­mend­ed a legal task force to assist the depart­ment in mak­ing the appli­ca­tion.
5.  21 U.S.C. § 822(d) (2020) gives the Attor­ney Gen­er­al of the Unit­ed States the author­i­ty to: “waive the require­ment for reg­is­tra­tion of cer­tain man­u­fac­tur­ers [Iowa Code §§ 124E.6, 124E.7], dis­trib­u­tors, or dis­pensers [Iowa Code §§ 124E.8, 124E.9] if he finds it con­sis­tent with the pub­lic health and safe­ty”.
6.  It goes with­out say­ing the Iowa Leg­is­la­ture thought a med­ical cannabis pro­gram was in the inter­est of pub­lic health and safe­ty.

Also worth read­ing is Gov­er­nor Reynold’s veto of House File 732 in 2019.  HF732 passed by 96–3 in the House and by 40–7 in the Sen­ate.  You can see that Gov­er­nor Reynolds places high val­ue on the advice of the Med­ical Cannabid­i­ol Board
